Welcome to MobiCharge. These Terms of Service ("Terms") govern your use of the MobiCharge website, mobile applications, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Acceptance of Terms

By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. We may modify these Terms at any time, and such modifications shall be effective immediately upon posting on our website. Your continued use of the Services following any modifications indicates your acceptance of the modified Terms.

2. Eligibility

You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Services on behalf of a company or organization, you represent and warrant that you have the authority to bind that entity to these Terms.

3. Account Registration

To use certain features of our Services, you may need to create an account. When you create an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

We reserve the right to suspend or terminate your account if any information provided during the registration process or thereafter proves to be inaccurate, false, or misleading, or if you fail to comply with these Terms.

4. Mobile Recharge Services

MobiCharge provides mobile recharge services for various operators in the UAE. By using our recharge services, you agree to the following:

  • You will provide accurate information about the mobile number to be recharged.
  • You understand that once a recharge is processed, it cannot be reversed or refunded.
  • You acknowledge that MobiCharge is not responsible for any issues related to the services provided by the mobile operators after the recharge is completed.
  • You agree to pay all charges associated with the recharge, including any applicable taxes or fees.

5. Payment Terms

When you make a payment through our Services, you agree to provide accurate and complete payment information. You authorize us to charge the designated payment method for the full amount of the transaction, including any applicable taxes and fees. All payments are processed securely through our payment processors.

We do not store your credit card information on our servers. All payment information is encrypted and securely processed by our payment partners in accordance with industry standards.

6. Refund Policy

Due to the nature of mobile recharge services, all transactions are final and non-refundable once processed. However, if a recharge fails to be credited to the intended mobile number due to a technical error on our part, we will either complete the recharge or refund the amount to your account or original payment method.

To request assistance with a failed transaction, please contact our customer support team within 24 hours of the transaction with your transaction ID and details of the issue.

7. Intellectual Property Rights

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of MobiCharge or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services without our prior written consent.

8. Prohibited Uses

You agree not to use our Services:

  • In any way that violates any applicable federal, state, local, or international law or regulation.
  • To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Services.
  • To attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Services, the server on which the Services are stored, or any server, computer, or database connected to the Services.
  • To attempt to probe, scan, or test the vulnerability of the Services or any associated system or network, or to breach security or authentication measures.
  • To use any automated means or process to access, retrieve, scrape, or index any portion of the Services.

9. Limitation of Liability

To the fullest extent permitted by applicable law, MobiCharge and its affiliates, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Services.
  • Any conduct or content of any third party on the Services.
  • Any content obtained from the Services.
  • Unauthorized access, use, or alteration of your transmissions or content.

In no event shall our total liability to you for all claims arising from or relating to these Terms or your use of the Services exceed the amount paid by you, if any, for accessing our Services during the twelve (12) months immediately preceding the date of the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless MobiCharge and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or your use of the Services shall be exclusively brought in the courts located in Dubai, UAE, and you consent to the personal jurisdiction of such courts.

12. Termination

We may terminate or suspend your access to all or part of the Services, without notice, for any conduct that we, in our sole discretion, believe is in violation of these Terms or is harmful to other users of the Services, to us, or to third parties, or for any other reason.
